Even the most serious crime, you know?
It's not a good defense to make a proportional argument, because you know, most of the people I 've met, most of the people I drive through the street, and I didn't kill them.
But even if you think it's impossible for Herman Kane to win the Republican party mix, it's impossible to get close to being president-elect, and the scandal around him is now itself a national phenomenon.
We are now in a big national struggle, not only about harassment, but also about accountability, about how we deal with serious allegations about powerful people, well-known people.
Kane's campaign and conservative campaign's response to the allegations surrounding his campaign has little to do with the substance of the allegations, answering whether Herman Kane actually harassed anyone.
The "talk Point Memo" has compiled a list of things called "not affecting whether Herman Kane sexually harassed two women aged 1990.
It's actually a huge two now.

So if Herman Kane really did these things, if you were a woman and you were sexually harassed by Herman Kane, his campaign would say, shut up, think twice before you say it.
This is a moment of accountability.
No one is held accountable without so much.
But because this is a very remarkable moment, what it means to be held accountable in the United States.
If you are sexually harassed by Herman Kane, think twice before you say anything.
The day after a woman publicly accused Trump, the threat did not appear to have been ignored.

Kane's campaign has set up a website dedicated to attacking her career and personal life.
Andrea perser, a New York Post columnist, teased her hair and make-up, saying her face was heavily painted, saying she needed a new eyeliner soon and called her a bleached blonde.

Dahlia, it's so nice of you to play.

Lili LITHWICK, Slate legal summary: Hey, Rachel.
MADDOW: you 've recently written about this, and Republicans are in a way just denying the existence of sexual harassment.
Do we even go above and beyond now, is it claimed to be an asset, and is it actually a kind of pride to be accused of sexual harassment to some extent?
Yes.
I mean, first of all, from what you set up there, you don't feel like the whole country is 1/2-year-old boys?
It's a surprise-you know, we were having a conversation in 2011 and we think we gave up decades ago.
I think the most striking thing is that if you think about the structure of sexual harassment laws in this country, in the past, it was impossible for a woman to come forward and say, I am a subordinate, I was harassed by powerful and important people.
It will ruin her life.
Surprisingly, we have established an entire legal system that encourages her to come forward and protect her from what she is not called a prostitute and a gold digger, however, despite such a legal structure, she is still a prostitute and Gold Hunter.
So, it's really surprising to acknowledge that we have problems and to establish a legal system to protect women.
Now, men are still victims when women stand up.
They have more victims than ever before.
Women have suffered from the total ugliness, insults, gender discrimination and stereotypes that happened 50 years ago, even before we talked about it.
We have a system to protect women, which is really a surprise.
You know, the reason why I want to host this show tonight, I feel like this is the most important thing in politics today, because I'm really shocked-I'm shocked by the very few in politics.
After reading the "think twice" review by lawyer Herman Kane, I was really shocked.
I thought about it, and I want to talk to you about the reason for this, and maybe it's normal in sexual harassment litigation and sexual harassment legal politics, because there is now an act of publicly intimidating the plaintiff, if you say someone has harassed you, you should be intimidated and even publicly informed that you will be dragged into the mud for doing so. Is that true? Is that normal?
Or did we think we had grown up in our 50 s?
No, this is crazy.
Your shocked response is the right one.
Under this system that we have, there is no lawyer who can properly say not to make a claim.
You know you're actually being harassed.
Think twice forward?
As I said before, the whole system is set up and harassment is pumped out.
Rachel, this is based on the idea that there is a huge imbalance in power, and that the troublemakers are not people who need system services.
So, for a lawyer who knows this, I will use my legal wisdom and the existing system to intimidate women from reporting, and the chilling effect is terrible.
So I think you're right.
When you have a system it's worse than having no system at all and you don't encourage it to be used.
Let me ask you a fake.
The assumption about this
I don't think the Herman Kane campaign will put any risk on his nomination-make him the Republican nominee or make him the president.
But I do think what is happening now around sexual harassment is a very big problem for this country, because it is essentially a demonstration project on how to deal with it.
So if you are the campaign manager for Herman Kane, or you are Herman Kane, the allegations have been made and you legally believe that you have not done anything wrong, these settlements are only for them to leave, they are dealt with as a matter of law and no one is guilty, all these allegations are false-the Kane movement insists it is false-and if so, what do you feel about the more responsible way forward on the political stage?
Given that this fact is being played on the national stage and will really affect how the country feels about it.
LITHWICK: I mean, I guess I can only respond by saying that what I'm not going to do is challenge the plaintiff.
You know, I wouldn't call them tramp and pole dancers.
I don't think they are gold hunters who like to go to court.
What you're trying to do, I think, is to say, look, it's settled on the facts.
When they are actually restricted by the settlement agreement, you will not call them anonymous plaintiffs and they will not stand up.
In other words, I think every feature in this campaign is to create a box, and if a woman reports, she is a gold picker.
If she does not report, she is also a gold miner.
She is a liar if she stands up.
She's also a liar if she doesn't stand up.
So, I think, the key is-let's solve this problem based on merit, let's not start by assuming that every single woman is desperate and eager to speed up --
Call the plaintiff's lawyer to humiliate the candidate.
Let's start by assuming we have two competing stories, and we need to address this.
But the fact that, as part of the hypothetical narrative, the plaintiff's narrative, she is a woman and a liar, wants to get rich quickly and reach a book deal has tarnished her.

On Capitol Hill today, the recruitment bill for veterans of our country was voted.
Our national unemployment rate is now about 9%.
For veterans of Iraq and Afghanistan, it is now 12 years old.
1%, because veterans in Iraq and Afghanistan are a very capable group of Americans, it is tragic and surprising.
Over the past decade, they have done very difficult, complex, tiring, tireless, and unvalued work.
I'm not romantic about this.
What I'm talking about is the actual situation.
This is an impressive, professional American class with a lot to offer.
They did do more before 9: 00. m.
More than most of us do all day.
They have been doing it for ten years and they are still doing it.
For our country, veterans of Iraq and Afghanistan are a great asset.
If you are recruiting employees in your company, you should look for them to recruit.
Still, they are having trouble in the job market, partly because when the people they compete for work have been working here, veterans have been working and experienced, but they have been doing it in Central Asia, inland.
So they are a very impressive team.
They did not perform well in the job market.
We know why.
By the way, we do owe them as a country.
So today, the smallest bill in the world is submitted to the Senate, the employment hero Oath Act of 2011, a tax credit for businesses to hire new veterans.
Congress is discussing various tax credits to hire employees.
This is for veterans.
It will not even increase the deficit.
They transferred funds from other veterans programs to cover the cost.
This is the least controversial thing in Washington.
This is good for the economy.
Frankly, this is good for our souls.
This is actually helpful for those who need practical help, because it's a job program that also helps all of us.
The vote for this today is 94-1.
The bill passed 94-1.

So, I do think there is a positive side to this-sorry-and the withdrawal of the bill from the Senate.
Another part of the story, the highway bill, does the House have its own version of the highway bill, which is not very consistent with the Senate version of the highway bill and costs less, the house is indeed where the gap is now stopped.
In the Senate, you can get something in the Democratic majority, in the rest of that collegial situation.
I think this is a real obstacle to concern right now.
MADDOW: that is to say, when we just received the infrastructure bill proposed by Senator Amy kolobchar, she brought it up with Joe Manchin, who is probably one of the most conservative Democrats, definitely one of the most conservative Democrats in the Senate last week, Ben Nelson and Joe Lieberman voted against it, and Republicans succeeded in blocking the vote.
But now we can see more roads and bridges moving forward in another way.

But isn't it worth it like a veteran? Really, Jim? Really?
But this is the case.
Look, the argument that this part of the Republican caucus is making is that everything is distorted.
So when you see that everything the government does is distorted, just like some sort of pure and natural state of the market, then, it is easy to see tax credits for hiring veterans as distorted, as unnatural, and not unnatural, with a veterans unemployment rate of up to 12%. MADDOW: Yes.
Hayes: that's exactly what I think we see broadly from the perspective of the Republican and most conscious members through the mirror, the crisis we're in now, the crisis of unemployment, the crisis of unemployment, loss of collateral redemption and personal bankruptcy is a natural state, and the intervention to change and repair these crises is unnatural.
MADDOW: unnatural, unnatural, and should not even be assessed on its merits, because-HAYES: Yes, because it is offensive in ideology.

First of all, after months of protests, the Obama administration is expected to approve a tar sand pipeline that runs through one of our country's largest sources of fresh water and has been delayed for at least a year.
The Obama administration says one reason for delaying the decision on the Keystone XL pipeline is that they are considering alternative routes.
Another major energy development in the last 24 hours is of course the good luck of the Department of Energy, and Rick Perry may has forgotten his plan to kill them.

The pantheon of those things is packed with Rick Perry.
The Cup spilled.
Last night, what Governor Perry was trying to remember was that if he were the president, the third government agency he would abolish would be the Department of Energy.
The Department of Energy operates nearly 40 facilities nationwide.
It's hard, we had to triple our graphics department to name them on this map.
These sites include the Los Alamos National Laboratory. Ring a bell?
During World War II, Robert Oppenheimer and his companions became spoilers of the world there.
We built the world's first atomic bomb in Los Alamos.
Today, Los Alamos is one of two facilities that the United States is still working on designing nuclear weapons and countless other things.
The budget is $2 billion.
It covers an area of 36 square miles, where there are about 10,000 employees.
What Rick Perry couldn't remember last night was that he wanted to abolish it.
The same is true of Oakridge factory in Tennessee.
They were in awe there.
Inspiring professional work like studying substances in atoms, cores, and subatomsnuclear levels.
Don't worry if you don't know what it means, because scientists at Oakridge know what it means, and thank God for that.
Experimental nuclear physics is not for the weak heart, nor for the budget of some local towns.
But if Rick Perry is the president and he remembers to do so, then there is no.

In Aiken, South Carolina, this is the Savannah National Laboratory of the Department of Energy, dedicated to improving the art of detecting weapons of mass destruction.

Lehmann, thank you very much for coming.
Ed Lehmann, Union of Concerned Scientists: Thank you for inviting me again.
MADDOW: the company that runs Davis-
Besse plant says cracks in the walls around these reactors are not dangerous because, in their words, these walls are only part of the building.
How do you react to this?
Lehmann: Well, the containment structure of the nuclear power plant is only really needed in the event of a serious accident.
If you remember, before Fukushima, we thought it was impossible for serious accidents to happen, so we really don't have to worry too much about them.
But if you have an event where the core is overheating, melting and can lead to a large amount of radioactive release, you do need that containment building to be as complete as possible structurally.
So, unless we have an accident, it doesn't matter the fact that it has a lot of cracks now.
MADDOW: in terms of how to find this, as far as I can see from the narrative we got, the media around this, and the information that the company has posted, we know all the cracks in all the other parts of this reactor facility because of this huge 30-foot-
They can't ignore the long ones.
No one is checking anyway.
They find these because they are almost accidental to find them.
Are you concerned about the system check and maintenance issues here?
This is a real problem.
With the aging of the national nuclear reactor, you really need to do more intensive maintenance and inspection, because you can't assume that you know everything that happens during these aging processes.
So, of course, the more checks you do, the more expensive it will be.
So, you know, there's an ongoing struggle between how many things you actually have to search for that you don't necessarily know.
So it is this struggle that is one of the main problems we are worried about with aging plants.
How do you find things that you really don't expect before things cause major problems?
MADDOW: Aging also seems to be one of the issues associated with the exposure case at plutonium, Idaho.
They describe a waste nuclear fuel container that could be corroded.
There are 16 people there who may be exposed to plutonium.
How terrible is this situation?

Lehmann: from a bigger point of view, the Department of Energy oversees a complex facility, many of which are aging again.
They were facilities during the Cold War.
They have been used for decades to process radioactive materials and produce nuclear weapons.
Cleaning up these facilities and maintaining these heritage sites is one of the great burdens facing the Department of Energy.
This is a good reason why we cannot abolish Doe because there is no other agency willing or able to manage these sites and deal with radioactive contamination.
As this incident shows, even the Department of Energy does not always know what it is doing.
So this is a complicated question.
We do have a wide range of radioactive materials, and aging facilities need to be managed in the most careful way possible to avoid polluting the environment, reaching out to the groups of workers, potential contamination and exposure of the public.
